On July 11, Minsk /BelTA/. President of Belarus Alexander Lukashenko signed the law "On Amnesty for Certain Categories of Persons Who Have Committed Crimes" on July 9. The text of the relevant normative legal act was registered in the National Register of Legal Acts on July 10, BelTA correspondent reports.
As reported, the document provides for the amnesty of minors, pregnant women, women and single men with children under 18 years of age, persons of retirement age, disabled persons of groups 1 and 2, patients with active forms of tuberculosis belonging to dispensary groups 1, 2, 5 "A" or 5 "B", cancer patients of clinical groups 2, 3 and 4, HIV-infected individuals with stages 3 (pre-AIDS) and 4 (AIDS) of the disease according to the WHO clinical classification, combat veterans and others, for committing crimes not classified as serious.
It also provides for the release from punishment of those convicted of embezzlement through abuse of official powers, appropriation or embezzlement, theft through the use of computer technology, for crimes against the order of economic activity, for abuse of power or official authority. However, by the date of the law's entry into force, they must have served at least one quarter of the imposed sentence.
In addition, persons who, on the day of consideration of materials on the application of amnesty, have less than one year remaining until the end of their sentence, and others, may be released.
At the same time, as before, persons (including those falling under the categories specified in other articles of the bill) who have been convicted of committing crimes of great public danger are not subject to amnesty. This includes crimes against peace and humanity, against the state, against life and health, against sexual inviolability. Amnesty will also not apply to those who have been granted amnesty or pardon during the period from 2005 to 2012; those who, by the date of the judgment's entry into force, have not compensated for the economic damage caused (except for the privileged category); those whose death sentence has been commuted to life imprisonment, etc. Amnesty will not apply to those who maliciously violate the order in correctional institutions, as well as those who have committed particularly dangerous recidivism of crimes.
In general, the amnesty is expected to affect about 7.6 thousand people. About 2 thousand of them are planned to be released directly from places of deprivation of liberty. In total, there are about 37 thousand prisoners in Belarus.
