The warranty period for accepted facilities and completed construction work in Belarus has been extended to 8 years

July 17, Minsk /BELTA/. The warranty period for commissioned facilities and completed construction works has been extended to eight years. The relevant decision is contained in the Resolution of the Council of Ministers No. 623 of July 12, 2013, which was published on the National Legal Portal, BELTA reports.

To improve the quality of construction facilities and enhance the responsibility of contractors in construction activities, the document decides to introduce a number of amendments and additions to the Rules for the conclusion and execution of construction contracts. In particular, the warranty period for commissioned facilities and completed construction works has been extended from five to eight years. An exception is made for technological, engineering, plumbing, electrical and other equipment, materials and products used for the construction of facilities (performance of construction works), the warranty period for which is established by legislation, including technical regulatory legal acts, or by the manufacturer. For current repair and commissioning works, the warranty period, according to the document, will be at least two years.

The resolution also states that the warranty period for components and parts of the main product used for the construction of facilities or the performance of construction works is considered equal to the warranty period for the main product, unless otherwise provided for in the technical regulatory legal acts for the main product.

The document also clarifies the contractor's liability for non-performance or improper performance of obligations stipulated by the contract, and for penalty payments to the customer. Thus, for the untimely elimination of defects indicated in the customer's acts, including those identified during the warranty period, the contractor is obliged to pay 2% of the cost of defect elimination works for each day of delay, starting from the day after the deadline specified in the act. Previously, the amount of these payments was 1%.

This resolution comes into force three months after its official publication and applies to contracts concluded after its entry into force.-0-
