A previously unconvicted 24-year-old citizen K., while in a state of alcoholic intoxication, on the premises of the "Kamen" farm of OJSC "Ladosno", i.e., in a public place, with the intent to grossly violate public order and demonstrating clear disrespect for society, in the presence of unrelated citizens, disregarding generally accepted norms of behaviour and communication among people in society, contrasting his personality above the interests of society and others, exhibiting bravado and physical superiority, intentionally, out of hooligan motives, without cause, with the aim of suppressing and degrading the honour and dignity of the victim V., struck the latter with at least two fist blows to the head, causing the victim bodily harm.
The accused fully admitted his guilt in committing the crime provided for by Part 1 of Article 339 of the Criminal Code of the Republic of Belarus, qualified as committing intentional actions that violate public order and express clear disrespect for society, accompanied by the use of violence (hooliganism).
The court recognised sincere remorse for the commission of the crime as a mitigating circumstance in the case.
The commission of the crime by a person in a state of alcoholic intoxication was recognised as an aggravating circumstance.
Taking into account the position of the state prosecutor, based on Part 1 of Article 339 of the Criminal Code of the Republic of Belarus, the court sentenced K. to community service for a term of 240 hours.
The court's sentence has entered into legal force.
