The District Prosecutor's Office has filed protests against the resolutions of the Acting Head of the Lepel District Department of Internal Affairs concerning the unlawful bringing of individuals to administrative responsibility.

During the inspection, it was established that a citizen of the Republic of Moldova entered the territory of the Republic of Belarus on 30.08.2017. The fifth day of her stay, 04.09.2017, fell on a Monday, which is a day off for the Citizenship and Migration Department of the Lepel District Department of Internal Affairs. On 05.09.2017, the citizen voluntarily appeared at the Citizenship and Migration Department of the Lepel District Department of Internal Affairs for registration. Consequently, there is no violation of Part 1 of Article 41 of the Law of the Republic of Belarus of 04.01.2010 No. 105-Z "On the Legal Status of Foreign Citizens and Stateless Persons in the Republic of Belarus" in her actions. Therefore, the administrative liability imposed under Part 1 of Article 23.55 of the Code of Administrative Offences of the Republic of Belarus is unlawful.

Furthermore, by a resolution of the Acting Head of the Lepel District Department of Internal Affairs, a citizen of the Republic of Belarus was brought to administrative responsibility under Part 4 of Article 23.55 of the Code of Administrative Offences of the Republic of Belarus for providing residential premises to the aforementioned citizen of the Republic of Moldova. A protest has been filed against this resolution due to the absence of an administrative offense in her actions.

The Lepel District Court has upheld the prosecutor's protests, annulled the resolutions on imposing administrative penalties, and terminated the proceedings in the cases.

The District Prosecutor's Office has conducted an inspection of compliance with the requirements of legislation on citizens' and legal entities' appeals to local executive and administrative bodies at the primary territorial level.

During the inspection, a number of violations of the aforementioned legislation were identified. For instance, officials of the Domzheritsy Village Council, when reviewing written appeals dated 27.06.2017 and 25.07.2017, failed to send responses to the applicants. Violations were also found regarding the maintenance of the Book of Remarks and Suggestions. For example, in the Lepel and Borovoye Village Executive Committees, the Book of Remarks and Suggestions lacks information on the results of appeal consideration and the dispatch of responses, despite the appeals having been reviewed.

Following the inspection, a submission was sent to the Lepel District Executive Committee to eliminate violations of the legislation on citizens' and legal entities' appeals, as well as the causes and conditions that contributed to these violations.
