During the preliminary and judicial investigation, it was established that a resident of Lepel district, having been previously convicted under Part 1 of Article 317-1 of the Criminal Code of the Republic of Belarus on 29.08.2017, and not possessing a driving license, while in a state of alcoholic intoxication, was driving his "Yugo Florida" car.

The same individual, being a person who had previously committed a crime stipulated by Article 317-1 of the Criminal Code of the Republic of Belarus, on September 19, 2017, also without possessing a driving license, while in a state of alcoholic intoxication, was driving his "Yugo Florida" car.

The court of Lepel district found the man guilty of committing a crime stipulated by Part 2 of Article 317-1 of the Criminal Code of the Republic of Belarus and imposed a penalty in the form of restriction of liberty for two years without direction to an open-type correctional institution, with deprivation of the right to engage in activities related to driving a vehicle for a period of 5 years, and a fine of 350 base units, amounting to 8050 rubles. Furthermore, in accordance with Part 1 of Article 107 of the Criminal Code of the Republic of Belarus, compulsory measures for the safety and treatment of chronic alcoholism were applied.

Specifically, the man, with a unified intent to systematically inflict beatings, abused his wife, with whom he cohabited, previously in 2016, while in a state of alcoholic intoxication, out of personal animosity arising from a quarrel, intentionally struck his wife at least once with his hand to the head.

In June 2017, while in a state of alcohol intoxication, due to personal animosity arising from jealousy, he intentionally inflicted numerous blows to his wife's body. Subsequently, without ascertaining whom his wife had spent the evening with, he took a leather belt from his trousers, held it in his hand, asked again where she had been and with whom, and then struck his wife with the belt on her back. In response to his wife's cries and pleas to stop, the man stated that it would hurt more, then tied several knots in the belt and inflicted at least two blows with the knotted belt on his wife's back.

The following day, he struck his wife at least once with his hand to the head, then pushed the victim, causing her to fall onto the asphalt on the roadway of the street, onto her lower limbs. He then grabbed her hair with his hand and dragged her for at least one meter. When the victim began to flee, he caught up with her, knocked her to the ground on the sandy shoulder of the street, took a handful of sand, pushed some of it into the victim's mouth, and then sat on top of her, grabbing her neck with his hands and squeezing it for at least a minute, thereby causing bodily harm to the latter.

During the court investigation, the parties filed a motion to terminate the criminal case due to reconciliation.

The court of Lepel District found the man guilty of committing a crime under Part 1 of Article 154 of the Criminal Code of the Republic of Belarus and sentenced him to one year of imprisonment without a fine. In accordance with Part 1 of Article 78 of the Criminal Code of the Republic of Belarus, it was decided not to execute the imposed sentence, provided that the accused does not commit a new crime within one year, fulfills the duties imposed by the court, and performs socially useful work for 120 hours in his free time.
