President of Belarus Alexander Lukashenko signed Decree No. 108 "On Insurance" on March 18. The document brings certain legislative acts into line with the Law "On Insurance Activities," which entered into force on January 1, 2025, the press service of the Head of State informed BELTA.
In particular, a number of decrees (and their individual structural elements) whose provisions are reflected in the law are declared invalid. The terminology used in legal acts, including in related legislation (tax, currency, banking, road traffic), is adjusted for consistency with the provisions of the law.
Among the innovations of the decree is the provision of an opportunity to pay insurance premiums (make payments) in cashless form using modern payment instruments; the establishment of insurance amounts and insurance premium rates in basic units (previously in euros) for mandatory insurance of vehicle owners and medical insurance of temporarily staying foreign citizens.
In addition, the contract for mandatory insurance of civil liability of vehicle owners is supplemented by the Union insurance contract, which is in effect in Belarus and Russia.
The procedure for insurance payments to victims of road traffic accidents is defined for cases where the carrier has not concluded a contract for mandatory liability insurance to passengers and it is impossible to recover damages through court. In cases of payments to drivers at the expense of guarantee funds, damage to life or health as a result of road traffic accidents involving wild animals, regardless of the driver's fault, has been added.
The decree provides for the possibility of making insurance indemnity payments to a non-resident in foreign currency under a contract for insurance of a resident's civil liability under an export contract.
For mandatory insurance against industrial accidents and occupational diseases, the maximum amounts that can be recovered by "Belgosstrakh" from those guilty of causing harm to insured persons in lieu of the insurance benefits paid to them are established (in case of intentional harm - 2 thousand basic units, without intent - 500). The conditions for an insured person to receive installment payments for overdue insurance premiums, fines, and penalties have been simplified.
The decree also introduces a number of restrictions on the activities of insurance intermediaries.
