President of Belarus Alexander Lukashenko signed Decree No. 227 "On Enhancing the Effectiveness of Control (Supervisory) Activities" on June 6. The relevant innovations were repeatedly considered at the head of state level, including during a recent meeting with the leadership of the Council of Ministers, the press service of the Belarusian leader informed BELTA.
The document amends the procedure for carrying out control (supervisory) activities, which was in effect based on Decree No. 510 of October 16, 2009, which is now declared invalid.
The new decree sets forth norms aimed at reducing bureaucracy and increasing the digitalization of processes. The obligation for business entities to keep a book of control (supervisory) measures and a work log is abolished (such information is already entered into the integrated automated system of control (supervisory) activities). The maintenance and use of a unified information database of controlling (supervisory) bodies have also been abolished.
The Decree approves the Regulations on the Procedure for Conducting Technical (Technological, Verification) Measures, which establishes the timelines, rights, and responsibilities of entities and officials of controlling (supervisory) bodies.
Norms concerning the liability measures of such bodies for violating the procedure for conducting inspections, monitoring, and technical measures have been established. The preventive role of monitoring has been strengthened by changing the approach to applying liability measures (they will be applied only if violations are not voluntarily rectified within the established period for each instance of their detection).
An obligation has been introduced for inspectors to set a deadline for rectifying identified violations based on their specifics. The objective possibility of rectifying the violation within the established period will be taken into account.
In addition, the terminology used in the legislation on control (supervisory) activities has been brought into line with other legislation.
