In accordance with the Regulation on the State Inspectorate for the Protection of Fauna and Flora under the President of the Republic of Belarus, approved by Decree of the President of the Republic of Belarus of 15.07.2019 No. 269.
In accordance with the Regulation on the State Inspectorate for the Protection of Fauna and Flora under the President of the Republic of Belarus, approved by Decree of the President of the Republic of Belarus of 15.07.2019 No. 269.
Officials of the State Inspectorate, within their competence and in compliance with the requirements established by law, are entitled to:
inspect territories, premises and other possible places for storing tools and means of obtaining natural resources, as well as the natural resources themselves and relevant documents;
use technical means, including equipment for sound and video recording, photography, photocopying, document scanning devices, hidden image identifiers;
verify identity documents and documents confirming authority from representatives of the inspected entity;
verify documents for the right to use fauna and flora, land, forest fund, to carry out fishing and hunting, to conduct fishing and hunting management, to carry out activities for the reproduction and protection of the forest fund, as well as identity documents of citizens, if there is data indicating that they have committed crimes or administrative offenses;
during control activities, to stop transport and floating means, vessels, to inspect belongings, transport and floating means, vessels, tools and means used for influencing natural resources, and other items, as well as to conduct personal searches of citizens;
to request and obtain, in accordance with legislation, written and oral explanations from employees of state bodies, other legal entities, and other citizens within the established timeframe, as well as necessary documents (their copies), including in electronic form, and other information on issues arising during control activities or necessary for their conduct;
to carry out the placement, including temporary placement, of movable property (vessels, vehicles, and other) within the boundaries of water protection zones or coastal strips without the оформление (registration) of title documents and permits for land plots.
(territories) within which control measures are carried out;
to seize tools and means used to affect natural resources, transport and floating facilities, vessels, natural resources, items that bear traces of crimes or administrative offences, as well as relevant documents, to demand immediate surrender (laying down) of weapons;
to deliver persons who have committed administrative offences, for which protocols are drawn up by authorised officials of the State Inspectorate, to internal affairs bodies for identification;
to seek clarification from employees of state bodies and other legal entities on emerging issues;
during field activities, to freely visit at any time of day facilities of legal entities and individual entrepreneurs upon presentation of an official ID, and facilities with restricted access in accordance with legislation – upon presentation of other documents stipulated by legislation for access to these facilities;
to temporarily restrict or prohibit the movement of citizens, as well as their access to certain areas of land and facilities, to oblige them to leave a specific place for procedural actions, to ensure the preservation of evidence or document verification;
Officials of the State Inspectorate, while performing their official duties, are representatives of state power and are under state protection.
Any influence, in any form whatsoever, on the said officials that hinders the performance of their official duties, or interference in their activities, is prohibited.
Liability for disobedience to a lawful order or demand of an official of a state body in the performance of their official powers by a person not subordinate to them in service, in accordance with Article 24.3 of the Code of Administrative Offences of the Republic of Belarus, entails the imposition of a fine ranging from two to one hundred base units, or community service, or administrative arrest.
