The Lepel Inter-district Inspectorate for the Protection of Fauna and Flora draws attention to the fact that in accordance with the Regulation on the State Inspectorate for the Protection of Fauna and Flora under the President of the Republic of Belarus, approved by Decree of the President of the Republic of Belarus of 15.01.2025 No. 27.
Officials of the State Inspectorate, within their competence and in compliance with the requirements established by law, are entitled to:
- inspect territories, premises and other possible places of storage of tools and means for obtaining natural resources, as well as the natural resources themselves and relevant documents;
- use technical means, including equipment for sound and video recording, photography, photocopying, document scanners, hidden image identifiers, as well as to record the surrounding environment by sound and video, and store the obtained information in compliance with the requirements of legislation on information, informatisation and information protection;
- check documents identifying the persons and confirming the powers of the representatives of the inspected entity;
- check documents for the right to use fauna and flora, land, forest fund, engage in fishing and hunting, manage fishing and hunting economies, carry out activities for the reproduction and protection of the forest fund, as well as identity documents of citizens, if there is information indicating that they have committed crimes or administrative offences;
- during control measures, stop vehicles and floating craft, vessels, inspect belongings, vehicles and floating craft, vessels, tools and means used for impacting natural resources, and other items, as well as conduct personal searches of citizens;
- to conduct personal searches of citizens and searches of items in their possession, including with the use of technical and special means, at the entrances to the protected facilities of the State Inspectorate in accordance with the rules established by legislation for the personnel of the paramilitary security, and to seize for temporary storage items and substances prohibited from being brought into the protected facilities of the State Inspectorate, according to the list determined by the head of the State Inspectorate, except for cases established by legislative acts;
- to request and receive in accordance with legislation from employees of state bodies, other legal entities, and other citizens, within the established timeframe, written and oral explanations, as well as necessary documents (their copies), including in electronic form, and other information on issues arising during control measures or necessary for their implementation;
- to carry out the placement, including short-term, within the boundaries of water protection zones or coastal strips of movable property (vessels, vehicles, and others) without the registration of title documents and permits for land plots (territories) within which control measures are carried out;
- to seize tools and means used for influencing natural resources, transport and floating means, vessels, natural resources, items that retain traces of crimes or administrative offences, as well as relevant documents, and to demand immediate surrender (laying down) of weapons;
- to deliver persons who have committed administrative offences, for which protocols are drawn up by authorised officials of the State Inspectorate, to the internal affairs bodies for identification;
- to apply to employees of state bodies and other legal entities for clarification of arising issues;
- during field activities, to freely visit at any time of day the facilities of legal entities and individual entrepreneurs upon presentation of a service ID, and facilities with restricted access in accordance with legislation – upon presentation of other documents provided for by legislation for access to these facilities;
- temporarily restricting or prohibiting the movement of citizens, as well as their access to specific areas of terrain and objects, prohibiting citizens from carrying out sound and video recording, photo and film shooting, obliging them to leave a certain place for procedural actions, ensuring the preservation of evidence or document verification;
Officials of the State Inspectorate, while performing their official duties, are representatives of state power and are under the protection of the state.
Any influence in any form on the said officials, hindering the performance of their official duties, or interference in their activities is prohibited.
Responsibility for disobedience to a lawful order or demand of an official of a state body while performing his official powers by a person not subordinate to him in service, in accordance with Article 24.3 of the Code of the Republic of Belarus on Administrative Offences, entails the imposition of a fine ranging from two to one hundred base units, or community service, or administrative arrest.
