The Prosecutor's Office of Lepel District supported the state prosecution against a 38-year-old resident of Lepel – he is charged with illegal acquisition, possession, and sale of a dangerous narcotic drug.
During the court investigation, it was established that a previously unconvicted 38-year-old resident of Lepel, for the purpose of sale within the territory of Lepel District, illegally acquired a dangerous narcotic substance – marijuana, with a total mass of not less than 48.4959 grams, which he intentionally, illegally possessed for the purpose of sale, and then transported to his place of residence, where he continued to illegally possess the said marijuana for the purpose of sale.
Continuing his criminal intent, during an unspecified period, but no later than 29.07.2024, while at his place of residence, he consumed a part of the acquired marijuana of an unspecified mass, and on 29.07.2024, while in a state of alcoholic intoxication and a state caused by the consumption of narcotic drugs, he illegally sold a part of the marijuana, weighing 15.89 grams, by gifting it to another person, while residing in the yard of his house. The remaining part of the said marijuana was continued to be illegally possessed for the purpose of sale at his place of residence until it was discovered and seized by law enforcement officers.
The accused X. fully admitted his guilt in committing the crime imputed to him during the court hearing.
The court recognised the offender's sincere remorse for the committed crime and the presence of a minor child dependent on him as mitigating circumstances.
The court considered the commission of the crime by a person in a state of alcoholic intoxication and the commission of the crime by a person in a state caused by the consumption of narcotic drugs as aggravating circumstances.
Taking into account the position of the state prosecutor and the identity of the offender, the court sentenced the accused to 3 years and 6 months of imprisonment, to be served in a correctional colony under an enhanced regime, without a fine.
Compulsory measures for the security and treatment of chronic alcoholism were applied to the accused X.
The marijuana, which is the instrument of the crime, was confiscated.
The court's verdict has entered into legal force.
