The Prosecutor's Office of Lepel District supported the state prosecution under Part 2 of Article 205 of the Criminal Code of the Republic of Belarus.
A previously convicted 55-year-old citizen residing in Lepel, having an unexpunged and unquashed conviction, committed an intentional crime again.
Specifically, between 14.05.2020 and 15.05.2020, with a single intent to intentionally, gratuitously, and unlawfully seize the property of citizens for mercenary motives, while intoxicated, he gained access to the basement of a residential building by picking the lock of a padlock and stole a bicycle, a chainsaw, and other electrical appliances, valued at over 700 rubles. He then absconded from the scene of the crime and disposed of the stolen property as he saw fit.
Upon the arrival of police officers, the accused confessed to the theft and voluntarily surrendered all stolen property.
The accused fully admitted his guilt at the court hearing.
Taking into account the position of the state prosecutor and mitigating circumstances, namely sincere remorse for the committed crime, the court sentenced him to 3 years of imprisonment to be served in a high-security penal colony.
In accordance with the "Law on Amnesty" in connection with the 75th anniversary of Victory in the Great Patriotic War of 1941-1945, the accused is partially exempted from punishment for a period of 1 year.
Furthermore, in accordance with Article 107 of the Criminal Code of the Republic of Belarus, compulsory measures for the safety and treatment of chronic alcoholism shall be applied to the accused.
Material evidence has been returned to the rightful owners.
The sentence has entered into legal force.
