The court of Lepel District considered a criminal case of expedited proceedings concerning the indictment of a resident of one of the villages of Lepel District, P., who, having been employed as a livestock breeder of the 5th category in an agricultural organization, intentionally, by misappropriation of entrusted property – diesel fuel, while on the territory of the district, using a hose and plastic canisters from the fuel tank of the tractor assigned to him, stole 200 litres of diesel fuel at least 6 times, thereby causing the farm damage totalling 490 rubles.

P. disposed of the stolen property at his own discretion.
The accused pleaded guilty in full.
Mitigating circumstances in the case were recognised as sincere remorse, voluntary partial compensation for damages, and the presence of a minor child dependent on him.
Aggravating circumstances in the case were not established.
Taking into account the position proposed by the prosecutor upon referral of the case to court, P. was sentenced by the court to 1 year of imprisonment with a fine of 60 basic units – 1920 rubles.
In accordance with parts 1 and 2 of Article 78, the sentence of imprisonment shall not be executed if, within a one-year probationary period, P. does not commit a crime and fulfils the duties imposed on him by the court.
In accordance with part 5 of Article 78, the court imposed on P. the obligation to perform socially useful work for 60 hours.
The court's sentence has entered into legal force.
