On the state of the fight against corruption crimes and offenses in the territory of Lepel district

In 2018, law enforcement and other district bodies implemented organisational, legal, practical, and other measures aimed at ensuring strict compliance with the requirements of anti-corruption legislation.

In 2018, 6 directives were sent to the Lepel District Department of Internal Affairs in accordance with sub-point 11.2 of point 11 of the Regulation on the activities of the Coordination Meeting on Combating Crime and Corruption, approved by Decree of the President of the Republic of Belarus of 17.12.2007 No. 644 (2017 – 8) concerning the detection of corruption crimes and offences in various areas:

- at enterprises and organisations of the energy sector;
- at enterprises of the district's agro-industrial complex (2);
- in the activities of healthcare system institutions;
- upon the request of citizen A. regarding the activities of KUPShP "Lepelskoe";
- in organisations and institutions of the district's culture sector.

As a result of the implementation of these directives, no corruption crimes or offences were detected.
The district prosecutor's office constantly analyses economic sectors and social spheres for corruption to identify areas for inspection and take timely response measures to prevent corruption.

Furthermore, in 2018, monitoring was carried out on the implementation of legislation on public procurement of goods (services) in rural executive committees, enterprises, and organisations of the district.

Based on the results of general supervisory inspections, 3 submissions were made (2017 – 3).

Submissions were made to: the Head of the Department of Internal Affairs of the Vitebsk Regional Executive Committee (for violations of legislation aimed at detecting and suppressing corruption crimes); the Lepel District Executive Committee (for violations of anti-corruption legislation and legislation on procurement using own funds in the Department of Ideological Work, Culture and Youth Affairs); the Chief Physician of Healthcare Institution "Lepel Central Regional Hospital" (for violations of anti-corruption legislation and legislation on public procurement).

6 orders were issued (2017 – 8), including 3 for violations of public procurement legislation (Lepel Rural Executive Committee, KUUP "Borovka", RKOO "BRSM"), and 3 for violations of legislation on procurement with own funds (UZ "Lepel Central District Hospital", GSHU "Lepel Variety Testing Station", Sports and Tourism Sector of Lepel District Executive Committee).

In 2018, 3 protests were filed against regulations on procurement with own funds (Department of Ideological Work, Culture and Youth Affairs of Lepel District Executive Committee, UZ "Lepel Regional Psychiatric Hospital", GSHU "Lepel Variety Testing Station") (2017 – 0).

Based on the results of inspections in 2018, official warnings about the inadmissibility of violations of anti-corruption legislation and public procurement legislation were not issued (2017 – 2).

1 disciplinary proceeding was initiated against 1 official for violations of public procurement legislation (2017 – 1).

Following the review of prosecutor's supervision acts, 9 officials were subjected to disciplinary action, including 5 for violations of public procurement legislation (2017 – 2).

The performance of some enterprises, organisations, and their managers in complying with anti-corruption legislation requirements is unsatisfactory.

In accordance with Part 1 of Article 43 of the Law of the Republic of Belarus "On Combating Corruption", heads of state and other organisations, within their competence, are obliged to take measures established by law aimed at combating corruption.

In 2018, a total of 9 corruption-related offences were identified – all of them were offences creating conditions for corruption (Article 25 of the Law "On Combating Corruption").

The Anti-Corruption Commission of Lepel District Executive Committee carried out its work in accordance with the plan approved for 2018. In 2018, 4 commission meetings were held, at which reports from officials of the Lepel District Department of Internal Affairs, organisations and enterprises of the district on compliance with anti-corruption legislation and public procurement legislation were heard.

At the same time, during the inspection of the Department of Ideological Work, Culture and Youth Affairs, it was established that the commitments taken from the heads of state institutions by the department contained references to the Law of the Republic of Belarus of 20.07.2006 No. 165-Z "On Combating Corruption", which lost its force on 24.01.2016.

Furthermore, the Lepel District Executive Committee conducts inadequate preventive work in subordinate institutions to prevent corruption, which prevents the early detection of corrupt practices and, in turn, leads to officials committing corruption-related crimes, discrediting and undermining the authority of local authorities.

However, the effectiveness of law enforcement agencies, and to a greater extent the Lepel District Department of Internal Affairs, has not increased due to certain objective and subjective reasons. The main reason for the low effectiveness is the lack of significant operational information about the commission of corruption and economic crimes, and the low level of professional training of the personnel of the Department for Combating Economic Crimes of the Lepel District Department of Internal Affairs.
