For reference. In accordance with Part 1 of Article 77 of the Labour Code of the Republic of Belarus, upon dismissal of an employee, all payments due to him from the employer on the day of dismissal (except for payments established by remuneration systems, the amount of which is determined by the results of work for a month or other reporting period) shall be made no later than the day of dismissal. If the employee was not working on the day of dismissal, or if a fixed-term employment contract with a probationary period is terminated on the last day of the probationary period, the relevant payments shall be made no later than the day following the day the employee demands settlement.
During the inspection, it was established that the employee was not paid their final settlement upon dismissal. In this regard, in order to restore the labour rights of the dismissed employee, the District Prosecutor issued a directive to the head of the agricultural enterprise to eliminate the legislative violations.
The supervision act has been fully implemented – the arrears in the final settlement owed to the employee have been settled.
