July 25, Minsk /BELTA/. The Government of Belarus has approved the regulations on the procedure for conducting electronic auctions for the sale of state property, including land plots, as well as the right to conclude lease agreements for state property, including land plots. The corresponding decision is contained in the Resolution of the Council of Ministers of July 12, 2013 No. 608, the BELTA correspondent was informed by the press service of the government.
In accordance with the resolution, the subject of electronic auctions is capital structures (buildings, structures), isolated premises, parking spaces, unfinished conserved capital structures, other real estate in state ownership, as well as unfinished unconserved capital structures, shares in the common ownership of real estate and unfinished unconserved capital structures. In addition, machines, equipment, vehicles, other movable property related to fixed assets, land plots sold into private ownership of Belarusian citizens for the construction and maintenance of single-family, block residential buildings, as well as non-state legal entities of the country, can be the subject of electronic auctions. The right to conclude land lease agreements, as well as the right to conclude lease agreements for capital structures (buildings, structures), isolated premises, parking spaces, and their parts, can also be put up for electronic auction.
The provisions do not apply to the organisation and conduct of electronic auctions for the sale of residential houses and residential premises, including those under construction, that are state-owned; shares (stakes in the charter capital) of business entities (partnerships), including those under the operational management or economic jurisdiction of state legal entities; securities; state property seized, arrested, confiscated or otherwise converted into state revenue. The provisions will also not apply to state property against which enforcement is sought for non-fulfillment of tax obligations, unpaid penalties; state property against which enforcement is sought in accordance with court orders; state property in the process of economic insolvency (bankruptcy); property of a state legal entity in the process of liquidation of that entity; as well as state property in the process of privatisation.
Electronic auctions are open. Participants may include persons who, in accordance with the law, may hold ownership or other proprietary rights to the property offered for electronic auction. The subject of electronic auctions may consist of one or more items and (or) one or more property rights. The organiser of electronic auctions is the seller or, based on a mandate agreement with the seller, a state organisation, as well as an organisation with a state share and (or) administrative-territorial unit in its charter capital exceeding 50%.
Auctions are held on the platform of the electronic trading platform operator on the day and at the time specified in the notice, by sequentially increasing the starting price of the subject of the electronic auction by participants by an amount equal to the step of the electronic auction. The step of the electronic auction, except for the first step, is set by the organiser of the electronic auction as a fixed amount ranging from 5 to 15% of the starting price of the subject of the electronic auction, and does not change during the entire period of their conduct. The first step of the electronic auction is set as a fixed amount equal to 5% of the starting price of the subject.
Electronic auctions shall be deemed to have failed if only one application for participation has been submitted, or if no application for participation has been submitted, or if only one or no participants have completed electronic registration on the electronic trading platform.
The Belarusian Universal Commodity Exchange and the communal unitary enterprise "Minsk City Real Estate Centre" are legal entities authorised to conduct electronic auctions for the sale of state-owned property, including land plots, as well as the right to conclude lease agreements for state property, including land plots.-0-
