President of Belarus Alexander Lukashenko signed Decree No. 5 "On Foreign Gratuitous Aid". A commentary on it has been posted on the portal of the National Centre for Legal Information, reports BELTA.
The document approves the Regulation on the procedure for receiving, accounting, registration, use of foreign gratuitous aid, control over its receipt and targeted use, as well as the registration of humanitarian programs.
The Regulation establishes a list of purposes for which foreign gratuitous aid and property acquired with funds from such aid may be used: elimination of the consequences of natural and man-made emergencies, conducting scientific research, promoting the protection of historical and cultural heritage, providing medical care, providing social assistance to citizens, etc.
It also defines the purposes for which gratuitous aid cannot be directed (carrying out extremist activities, other acts prohibited by law, financing political parties, preparing and conducting elections and referendums, etc.) and which goods cannot be provided as aid (e.g., goods prohibited for import).
The Regulation details the issues related directly to the procedure for receiving gratuitous aid and its use.
It is established that the provisions of the Regulation do not apply to: international technical assistance; foreign gratuitous aid provided under projects and programs approved by the President, as well as in accordance with interstate agreements in force for Belarus; foreign gratuitous aid received by diplomatic missions and consular institutions of Belarus, banks and non-bank financial and credit organizations, the National Bank, OJSC "Development Bank of the Republic of Belarus".
In addition, the Decree establishes the procedure for spending foreign gratuitous aid received by the country's diplomatic missions and consular institutions.
The right to clarify issues related to the application of the Decree is granted to the Office of the President.
