Reconciliation agreements have been signed in 79% of cases considered by the Economic Court of the Vitebsk Region within the reconciliation procedure in the first half of the year, Olga Kibisova, Head of the Judicial Practice Department of the regional economic court, told BELTA correspondent.
As the interlocutor explained, the reconciliation procedure is the settlement of a dispute between parties in an economic court with the participation of a conciliator appointed by the court, to assist them in independently resolving the dispute, establishing the factual circumstances of the conflict, clarifying, comparing and bringing together their points of view on ways to resolve the dispute, finding a compromise acceptable to both parties, and reaching a reconciliation agreement. Such a dialogue with the assistance of a professional conciliator allows for a mutually beneficial agreement, saving money and time, and preserving reliable partnerships.
In January-June 2012, agreements and reconciliation agreements were reached and signed between parties in 425 cases of the claim proceedings, which is 79% of the cases considered within the reconciliation procedure. In two successfully settled cases, the parties resorted to the assistance of an out-of-court mediator. The potential of the reconciliation procedure was also in demand at the stage of enforcement proceedings: in 28 cases, the procedure was completed, 27 reconciliation agreements were concluded within the framework of enforcement proceedings, and another 6 cases are at the reconciliation stage.
The active implementation of modern electronic technologies by the economic court helps to save the funds of business entities resorting to judicial dispute resolution, Olga Kibisova noted. For example, using videoconferencing, first-instance judges held 97 court hearings. To expand the scope of electronic document management, the economic court has concluded 19 agreements on electronic information exchange, including with 11 crisis managers for all bankruptcy cases of legal entities and individual entrepreneurs, including when appealing court decisions in the economic court of appeal instance, as well as at the enforcement stage. As a result, business entities saved money on travel expenses, and their representatives saved working time.
For the first six months of the current year, the number of applications received for consideration by the Economic Court of the Vitebsk Region increased by 15% to 7467 applications. Business entities continue to effectively recover debts using the procedure of order production: 5567 applications for the initiation of order production were submitted to the court, which is 1.5 times more than in the same period of 2011. -0-
