Law on Industrial Safety Adopted

The current law on industrial safety was adopted 15 years ago, and the need for its revision has long been overdue. And so, on January 5, 2016, by Decree No. 354-Z, the President approved the Law "On Industrial Safety".

Hazardous production facilities (hereinafter referred to as HPF) are divided into three types depending on the level of potential accident hazard: extremely high hazard HPF (I), high hazard HPF (II), and medium hazard HPF (III).

A new type of facility has also appeared – a potentially hazardous facility (hereinafter referred to as PHF). These facilities are listed in Appendix 2 to the Decree.

The procedure for maintaining the state register of HPF has been determined – any such facility will be registered before the start of operation and excluded from it only after decommissioning. All law enforcement agencies operating hazardous production facilities will maintain departmental sections of the register through remote access.

The Law establishes a new list of industrial safety expertise objects and prescribes the development of industrial safety declarations for hazardous production facilities of hazard types I and II, as well as the entry of information about such declarations into the state register of hazardous production facilities.

The Law also obligates the owner:

Of HPF and PHF to develop and approve the "Regulations on the Procedure for Organizing and Implementing Industrial Safety Production Control", which must be developed based on the model regulations on organizing and implementing industrial safety production control approved by the Ministry of Emergency Situations of the Republic of Belarus;
Of HPF of hazard types I and (or) II, to establish an industrial safety service;
Of HPF of hazard type III and (or) PHF, to introduce the position of an industrial safety engineer into the staff or to assign the relevant industrial safety responsibilities to a responsible person.

The Law enters into force on July 15, 2016.
