Hundreds of residents of our region and thousands across the republic die annually from accidental alcohol poisoning. Far from all of those who died are people of anti-social status. Often, workers, rural labourers, pensioners, and even young people become victims of alcohol. And the reason for this is most often the illegal sale of alcoholic beverages. People who profit from the misfortune, health, and destinies of others are indifferent – think about this.
The priority activity for employees of the Lepel District Department of Internal Affairs has been and remains preventive work. It is no secret to anyone that it is better to prevent a crime than to solve it afterwards. The main focus in preventive activities is on preventing drunkenness.
As a result, in 2017, a total of 1339 people were brought to administrative responsibility for drinking alcohol in a public place or appearing in a public place while intoxicated (2016 - 1326). 82 people were brought to responsibility for being at work during working hours in a state of alcohol intoxication (2016 - 77).
72 outbreaks of moonshine production were detected.of (2016- 68), 848.87 (2016-977.9) ** ** litres of moonshine, moonshine mash were seized. **
Based on the Decree of the *President of the Republic of Belarus No. 5 of 08.11.2016 "On the movement, storage and sale of alcoholic beverages by individuals"*, liability is provided, namely:
**Clause 2. Movement within the territory of the Republic of Belarus by an individual who is not an individual entrepreneur of more than 5 litres of alcoholic beverages not marked in the prescribed manner with excise stamps of the Republic of Belarus and (or) special stamps –**
entails the imposition of a fine in the amount of ten to one hundred basic units with confiscation of alcoholic beverages exceeding the quantity allowed for movement, or without confiscation.
**The act provided for in the first part of this clause, committed repeatedly within one year after the imposition of an administrative penalty for the same violation –**
entails the imposition of a fine in the amount of twenty to one hundred basic units with confiscation of alcoholic beverages exceeding the quantity allowed for movement, as well as vehicles used for the movement of alcoholic beverages (incof public transport vehicles), regardless of their ownership, or without confiscation of such vehicles.
Sale (in the absence of signs of illegal entrepreneurial activity) by an individual, who is not an individual entrepreneur, of alcoholic beverages not marked with excise stamps of the Republic of Belarus and (or) special stamps in the prescribed manner, as well as homemade alcoholic beverages –
entails a fine of five to twenty basic units with confiscation of the alcoholic beverages sold, as well as confiscation of alcoholic beverages not marked with excise stamps of the Republic of Belarus and (or) special stamps in the prescribed manner, homemade alcoholic beverages belonging to the guilty person or located at the place of the offense at the time of its commission, or without confiscation of such alcoholic beverages.
The act provided for in part three of this item, committed repeatedly within one year after the imposition of an administrative penalty for the same offense –
entails a fine of ten to thirty basic units with confiscation of the alcoholic beverages sold, as well as confiscation of alcoholic beverages not marked with excise stamps of the Republic of Belarus and (or) special stamps in the prescribed manner, homemade alcoholic beverages belonging to the guilty person or located at the place of the offense at the time of its commission.
Article 12.27 of the Code of Administrative Offences of the Republic of Belarus: Illegal import, transportation, storage of alcoholic beverages and tobacco products, production, processing and storage of ethyl alcohol and tobacco raw materials and sale of alcoholic beverages
3. Production, processing, storage in the Republic of Belarus, transportation across its territory by individuals of more than five litres of ethyl alcohol, including that which is classified as alcoholic beverages, as well as tobacco raw materials in quantities exceeding ten kilograms, and their sale (regardless of volume) -
shall entail a fine of up to one hundred base units with confiscation of the specified alcohol, tobacco raw materials, as well as equipment and raw materials used for their production or processing.
4. Sale by an individual, who is not an individual entrepreneur, of alcoholic beverages, including those of own production, in the absence of signs of illegal entrepreneurial activity -
shall entail a fine of five to twenty base units with confiscation of the alcoholic beverages being sold.
5. Production (manufacturing), involvement in circulation by an individual, who is not an individual entrepreneur, of counterfeit alcoholic beverages, as well as their transportation across the territory of the Republic of Belarus, storage by such individual of knowingly counterfeit alcoholic beverages, their trade -
shall entail a fine of one hundred to two hundred base units with confiscation of counterfeit alcoholic beverages, equipment, raw materials and materials used for their production (manufacturing).
Article 12.43 of the Code of Administrative Offences of the Republic of Belarus: Manufacturing or acquisition of strong alcoholic beverages (samogon), semi-finished products for their manufacturing (braga), storage of apparatuses for their manufacturing
1. Manufacturing by individuals of strong alcoholic beverages (samogon), semi-finished products for their manufacturing (braga), as well as storage of apparatuses used for their manufacturing, -
shall entail a warning or a fine of up to five base units with confiscation of the specified beverages, semi-finished products and apparatuses.
2. The same acts committed repeatedly within one year after the imposition of an administrative penalty for the same violations, or the production or storage by individuals of strong alcoholic beverages (moonshine) in quantities exceeding five litres, semi-finished products for their production (mash) in quantities exceeding thirty litres -
shall entail the imposition of a fine ranging from five to thirty basic units with the confiscation of the said beverages, semi-finished products and apparatus.
3. The acquisition of strong alcoholic beverages (moonshine), with the exception of those whose sale is permitted by law, as well as the acquisition of semi-finished products for their production (mash) -
shall entail a warning or the imposition of a fine of up to five basic units with the confiscation of the said beverages.
