Hundreds of residents of our region and thousands across the republic die annually from accidental alcohol poisoning. Far from all of those who died are people of anti-social status.

Hundreds of residents of our region and thousands across the republic die annually from accidental alcohol poisoning. Far from all of those who died are people of anti-social status. Workers, rural labourers, pensioners, and even young people often fall victim to alcohol. The reason for this is most often the illegal sale of alcoholic beverages. Those who profit from the misfortune, health, and fates of others are indifferent – think about this.

The priority activity for the employees of the Lepel District Department of Internal Affairs has been and remains preventive work. It is no secret to anyone that it is better to prevent a crime than to solve it afterwards. The main focus in preventive activities is on the prevention of drunkenness.

 As a result, in 2018, a total of 1412 individuals (1339 in 2017) were brought to administrative responsibility for drinking alcoholic beverages in a public place or appearing in a public place while intoxicated. 80 individuals (82 in 2017) were brought to responsibility for being at their workplace during working hours in a state of alcohol intoxication.

69 cases of moonshining were detected (72 in 2017), and 784.54 litres (848.87 in 2017) of moonshine, mash, and other non-certified alcoholic beverages were seized.

 In accordance with Article 12.27 of the Code of Administrative Offences of the Republic of Belarus:Illegal movement, storage of tobacco products and alcoholic beverages, production, processing, storage, movement of non-food alcohol-containing products, ethyl alcohol, tobacco raw materials, sale of these products, alcohol, raw materials and alcoholic beverages.

2. The movement by an individual, who is not an individual entrepreneur, of more than five litres of alcoholic beverages not marked in the prescribed manner with excise stamps of the Republic of Belarus and (or) special stamps across the territory of the Republic of Belarus –

shall entail a fine of from ten to one hundred base units with confiscation of alcoholic beverages exceeding the permitted quantity, or without confiscation.

2-1. The act provided for in part 2 of this article, committed repeatedly within one year after the imposition of an administrative penalty for the same violation –

shall entail a fine of from twenty to one hundred base amounts with confiscation of alcoholic beverages exceeding the permitted quantity for transportation, as well as vehicles used for the transportation of alcoholic beverages (except for public transport), regardless of their ownership, or without confiscation of such vehicles.

3. Production (manufacture), processing, storage within the territory of the Republic of Belarus, transportation within it by an individual who is not an individual entrepreneur, of more than five litres (five kilograms) of non-food alcohol-containing products, more than five litres of ethyl alcohol obtained from food raw materials, more than five litres of non-food ethyl alcohol, more than ten kilograms of tobacco raw materials, as well as the sale of the aforementioned products, alcohol and raw materials (regardless of volume) –

shall entail a fine of from ten to one hundred base amounts with confiscation of non-food alcohol-containing products, alcohol, tobacco raw materials exceeding the quantity permitted for production (manufacture), processing, storage, transportation, as well as equipment and raw materials used for their production (manufacture) or processing, or without confiscation.

4. Sale (in the absence of signs of illegal entrepreneurial activity) by an individual who is not an individual entrepreneur, of alcoholic beverages not marked in the prescribed manner with excise stamps of the Republic of Belarus and (or) special stamps, or homemade alcoholic beverages –

shall entail a fine of from five to twenty base amounts with confiscation of the alcoholic beverages being sold, as well as confiscation of alcoholic beverages not marked in the prescribed manner with excise stamps of the Republic of Belarus and (or) special stamps, homemade alcoholic beverages belonging to the offender or located at the place of commission of the offence at the time of its commission, or without confiscation of such alcoholic beverages.

4-1. An act provided for in part 4 of this Article, committed repeatedly within one year after the imposition of an administrative penalty for the same offence –

shall entail a fine of ten to thirty base units with confiscation of alcoholic beverages sold, as well as confiscation of alcoholic beverages not marked in the prescribed manner with excise stamps of the Republic of Belarus and (or) special stamps, and homemade alcoholic beverages belonging to the offender or located at the place of commission of the offense at the time of its commission.

5. Production (manufacture), circulation by an individual, who is not an individual entrepreneur, of counterfeit alcoholic beverages, as well as transportation within the territory of the Republic of Belarus, storage by such individual of knowingly counterfeit alcoholic beverages, and trade in them –

shall entail a fine of one hundred to two hundred base units with confiscation of counterfeit alcoholic beverages, equipment, raw materials, and supplies used for their production (manufacture).

Article 12.43 of the Code of Administrative Offences of the Republic of Belarus: Manufacture or acquisition of strong alcoholic beverages (samogon), semi-finished products for their manufacture (braga), storage of apparatus for their manufacture

1. Manufacture by individuals of strong alcoholic beverages (samogon), semi-finished products for their manufacture (braga), as well as storage of apparatus used for their manufacture –

shall entail a warning or a fine of up to five base units with confiscation of the specified beverages, semi-finished products, and apparatus.

2. The same acts committed repeatedly within one year after the imposition of an administrative penalty for similar offenses, as well as the manufacture by an individual of more than five liters of strong alcoholic beverages (samogon), more than thirty liters of semi-finished products for their manufacture (braga), or storage of more than thirty liters of such semi-finished products –

shall entail a fine of five to thirty base units with confiscation of the specified beverages, semi-finished products, and apparatus.

3. Acquisition of strong alcoholic beverages (samogon), except for those whose sale is permitted by law, as well as acquisition of semi-finished products for their manufacture (braga) –

shall entail a warning or a fine of up to five base units with confiscation of the specified beverages.

Note. For the purposes of this article, strong alcoholic beverages (samogon) are understood as alcoholic beverages with an ethyl alcohol content of 28 percent or more, produced by individuals through fermentation of raw materials followed by distillation.
