The Prosecutor's Office of Lepel District supported the state prosecution in a criminal case under Part 2 of Article 427 of the Criminal Code of the Republic of Belarus.

The Prosecutor's Office of Lepel District supported the state prosecution in court under Part 2 of Article 427 of the Criminal Code of the Republic of Belarus.

Previously, non-convicted officials of KUPSHP "Lepelskoe", by prior conspiracy, possessing reliable information about the number of livestock deaths, intentionally, contrary to the interests of service, using their official powers, out of personal interest, with the aim of distorting data in state statistical reporting form 12-sx "Livestock", as well as with the aim of concealing improper work in the field of livestock farming at KUPSHP "Lepelskoe", and thereby preventing the привлечение to material and disciplinary responsibility, in cases of a significant number of livestock deaths, acting with a common intent, during the period from 01.01.2021 to 30.07.2021, during daytime hours, being in the administrative building of KUPSHP "Lepelskoe" and the premises of the livestock farm "Bolshoy Polsvizh", located in the agro-town of Bolshoy Polsvizh, Lepel District, in execution of the head's instructions, monthly entered knowingly false information and records into official documents, namely, into acts of livestock and poultry disposal form 302-APK, approved by the Resolution of the Ministry of Agriculture and Food of the Republic of Belarus dated 22.11.2005. The acts, after compilation, were approved by the head and transferred to the accounting department for the purpose of forming accounting statements.

As a result of the criminal actions of five officials of KUPSHP "Lepelskoe", unreliable information regarding the disposal of 47 heads of cattle was entered into the disposal acts from January to July of the current year.

The above became the reason for the concealment and distortion of data on the death of 47 heads of young cattle in state statistical reporting.

The accused, with the exception of the former head of the farm, fully admitted their guilt in committing the crime provided for by Part 2 of Article 427 of the Criminal Code of the Republic of Belarus. Mitigating circumstances in this case included sincere remorse and the presence of young children dependent on the accused.

The court recognized the commission of the crime by a group of persons by prior conspiracy as an aggravating circumstance.

Taking into account the position of the state prosecutor, based on Part 2 of Article 427 of the Criminal Code of the Republic of Belarus, the court imposed a sentence on the farm officials (with the exception of the head) – in the form of

imprisonment for a term of 1 year, as well as disqualification from holding positions related to the performance of organizational, managerial, and administrative-economic duties for a term of 1 year.

The former head of the farm, based on Part 2 of Article 427, was sentenced to imprisonment for a term of 2 years, with disqualification from holding positions related to the performance of organizational, managerial, and administrative-economic duties for 3 years.

In accordance with Part 2 of Article 77 of the Criminal Code, the court granted a deferral of the execution of the main and additional punishment for 1 year in respect of all five defendants.

In addition, each of the defendants is obliged to perform socially useful work for 100 hours.

The court's sentence has not yet entered into legal force.
