The Prosecutor's Office of Lepel District supported the state prosecution in court under Part 2 of Article 205 of the Criminal Code of the Republic of Belarus.
A previously convicted 63-year-old resident of Lepel, by prior conspiracy with a previously unconvicted 64-year-old resident of Lepel, acting as a group of persons, with a common intent to intentionally, gratuitously, unlawfully seize another's property, out of mercenary motives, while on the land plot of a resident of the village of Malye Pyshnyagory, Lepel District, by free access, using a pitchfork and polymer bags, secretly stole more than 50 kg of potatoes from the plot.
The accused pleaded guilty to committing the crime provided for by Part 2 of Article 205 of the Criminal Code of the Republic of Belarus.
Taking into account the mitigating circumstance in the case – the sincere repentance of the accused, as well as considering the position of the state prosecutor, the previously convicted accused was sentenced by the Lepel District Court, based on Part 2 of Article 205 of the Criminal Code of the Republic of Belarus, to a fine of 35 basic units – 1015 rubles.
In accordance with Part 1 of Article 73 and Part 8 of Article 77 of the Criminal Code of the Republic of Belarus, by full aggregation with the imposed punishment of the unserved punishment under the sentence of the Lepel District Court of 24.06.2020 in the form of imprisonment, the accused was finally sentenced to a fine of 1015 rubles to the state revenue and imprisonment for a term of 2 years with serving the sentence in a correctional colony under a general regime.
The accused resident of Lepel was sentenced under Part 2 of Article 205 of the Criminal Code of the Republic of Belarus to a fine of 30 basic units – 870 rubles.
A special confiscation of the pitchfork and horse-drawn cart was applied based on Article 46-1 of the Criminal Code of the Republic of Belarus.
The sentence has entered into legal force.
