The Prosecutor's Office of Lepel District supported the state prosecution in court under Part 3 of Article 339 of the Criminal Code of the Republic of Belarus.
A 27-year-old resident of Lepel, with no prior convictions, between 23:32 on 07.10.2022 and 00:15 on 08.10.2022, intending to commit an especially malicious hooliganism, while on a street in Lepel, intentionally, grossly violating public order and showing blatant disrespect for society, exhibiting bravado and boastfulness, in the presence of a third party, disregarding generally accepted norms of social behaviour, opposing his personality to the interests of society, without any cause or reason, out of hooligan motives, with a threat of violence, expressed verbally, and also by the convicted person, wishing to instill fear and insecurity in the victim regarding their personal safety, threatened to use a hunting double-barrelled shotgun he possessed and fired at least three shots from it.
The accused fully admitted guilt for the crime imputed to him during the court hearing and repented of his actions.
The court considered the following as mitigating circumstances: sincere repentance for the committed crime, having a minor child dependent on him, and voluntary compensation for the damage caused by the crime.
The court found no aggravating circumstances.
Taking into account the position of the state prosecutor, based on Part 3 of Article 339 of the Criminal Code of the Republic of Belarus, the court imposed a sentence of restriction of liberty for a term of 2 years and 6 months with placement in an open-type correctional institution.
In accordance with the Law of the Republic of Belarus "On Amnesty in connection with the Day of National Unity" dated 07.12.2022, the convicted person was partially exempted from the sentence of restriction of liberty for a period of one year.
The hunting double-barrelled shotgun was confiscated for the benefit of the state as a means of committing the crime.
The court's verdict has entered into legal force.
