The Prosecutor's Office of Lepel District supported the state prosecution in part 1 of Article 147 of the Criminal Code of the Republic of Belarus.
A 45-year-old resident of Lepel, with no prior convictions, travelled to the forest by minibus in early August 2019 to pick berries with his acquaintances. While picking berries, citizen N. rudely and obscenely warned a resident of Lepel, insulting him, not to pick berries ahead of everyone else "like a combine harvester". There were no further conflicts between them, and everyone left the forest peacefully in the minibus. Upon arrival in the village, near a water tower, there was a resident of Lepel; a metal pipe was inserted into the tower instead of a handle. Citizen N. approached this tower to drink water, the resident of Lepel snatched the metal rod from the tower. Frightened, citizen N. started to run away, but he got tired of running, and the accused carried out his intent to the end, striking him at least three times on the upper limbs and at least once on the head, causing grievous bodily harm.
The resident of Lepel did not admit guilt in the committed crime, explaining that he had inflicted bodily harm in self-defence against citizen N. inflicting bodily harm on him and had exceeded the limits of necessary defence.
Taking into account the opinion of the state prosecutor, the court of Lepel District found the resident of Lepel guilty of committing the crime stipulated by part 1 of Article 147 of the Criminal Code of the Republic of Belarus and sentenced him to 4 years of imprisonment to be served in a correctional colony under an enhanced regime.
This sentence of the court of Lepel District has not yet entered into legal force.
