In early May 2023, citizen G., previously not convicted, while in a state of alcoholic intoxication, in the yard of a house in Lepel, during a quarrel with the victim K., which arose from personal animosity, acting negligently, not foreseeing the possibility of grave socially dangerous consequences in the form of a person's death – the victim K. – as a result of his actions, although with necessary attention and foresight, he should have and could have foreseen these consequences, struck the victim in the face with his fist, from which the latter fell and hit his head on the asphalt surface. As a result, the victim K. sustained a closed head injury, which is in direct causal relationship with his death. The victim died in the hospital 7 days later from the injuries sustained.
The court recognized sincere remorse of the accused and partial compensation for damages as mitigating circumstances.
The court recognized the commission of the crime by a person in a state of alcoholic intoxication as an aggravating circumstance.
Taking into account the position of the state prosecutor, the court found the accused guilty of the crime provided for by Part 1 of Article 144 of the Criminal Code of the Republic of Belarus and sentenced him to 1 year and 6 months of imprisonment with serving the sentence in a penal colony in a settlement regime. The convicted person was also ordered to pay material compensation for moral damage to the victims.
The sentence has entered into legal force.
