The Lepel District Prosecutor's Office supported the state prosecution under Part 1 of Article 205 of the Criminal Code of the Republic of Belarus.
In early May 2023, citizen X, who had no prior convictions, with the intent of intentionally, gratuitously, and unlawfully seizing the property of SPF "Zaiozerie" of OJSC "Vitebsk Meat Processing Plant", for mercenary motives, by free access, while in a field near the village of Lyakhovichi, Lepel District, intentionally, by theft, using a hose and 10 canisters, secretly stole 230 litres of diesel fuel from the tractor's tank, valued at 2.38 rubles per litre, for a total amount of 547.40 rubles, causing material damage to SPF "Zaiozerie" of OJSC "Vitebsk Meat Processing Plant" in the specified amount, after which he sold the stolen property to another person.
The court recognised the accused's sincere remorse as a mitigating circumstance.
The court did not establish any aggravating circumstances for the accused's responsibility.
Taking into account the position of the state prosecutor, the court found the accused guilty of the crime provided for by Part 1 of Article 205 of the Criminal Code of the Republic of Belarus and imposed a penalty in the form of correctional labour for a term of 1 year and 6 months, with 15% of his earnings from his primary place of employment to be withheld for the benefit of the state, but not less than one basic unit per month. The sentence has entered into legal force.
