The Prosecutor's Office of Lepel District supported the state prosecution in the case under Part 1 of Article 328 of the Criminal Code of the Republic of Belarus.
Citizen K., who has no prior convictions, in collusion with citizen S., in mid-April 2023, using a mobile phone of the "Iphone 11" brand, belonging to citizen K., with the "Telegram" system installed, by means of correspondence and subsequent payment, obtained information from an unidentified person about the location of a white powdery substance (a particularly dangerous psychotropic substance - amphetamine) weighing at least 1.73 grams in a designated place (cache) located in the "Krasnaya Sloboda" Park of Culture and Recreation on Uborevich Street in Minsk. Thus, they intentionally and illegally acquired the particularly dangerous psychotropic substance from an unidentified person without intent to sell. Subsequently, they travelled to Minsk, retrieved it from the cache, began to keep it with them, and transported it by taxi, public transport of the Minsk Metro, and by route taxi throughout Minsk, Minsk Region, Vitebsk Region, and Lepel until their detention, discovery, and seizure of the particularly dangerous psychotropic substance from them on Minsk Street in Lepel.
The court recognized the sincere remorse of the accused as a mitigating circumstance.
The court recognized the commission of the crime by a group of persons by prior conspiracy as an aggravating circumstance.
Taking into account the position of the state prosecutor, the court found the accused guilty of illegal acquisition, possession, and transportation of psychotropic substances without intent to sell, and based on Part 1 of Article 328 of the Criminal Code, each was sentenced to two years of imprisonment. In accordance with Parts 1 and 2 of Article 78 of the Criminal Code, the imposed sentence of imprisonment shall not be executed if, during a two-year probationary period, they do not commit a new crime and fulfill the obligations imposed on them by the court. Pursuant to Part 5 of Article 78 of the Criminal Code, each was obligated to perform socially useful work for 100 hours in their free time from work and/or study, and to pay a criminal legal compensation of 50 base units each, amounting to 1850 Belarusian rubles, within six months after the sentence enters into legal force.
