The Prosecutor's Office of Lepel District supported the state prosecution under Part 1 of Article 328 of the Criminal Code of the Republic of Belarus.
A resident of Baranovichi, Brest Region, with no prior convictions, having learned from an acquaintance that drug stashes could be found near the railway tracks close to the Baranovichi railway station, set off in search of other people's stashes. Moving along the railway tracks, he found two parcels wrapped in black electrical tape, containing mephedrone. Knowing that this psychotropic substance emits a specific odour, the accused first sniffed the found parcel and put it in his pocket, and then put the second parcel also in his jacket pocket. Afterwards, he took a taxi to Lepel to visit an acquaintance. En route, he transferred the parcels to an empty cigarette pack for personal consumption. Upon arrival in Lepel, he was detained by police officers.
The court recognised the defendant's sincere remorse as a mitigating circumstance.
The court found no aggravating circumstances for the defendant.
Taking into account the position of the state prosecutor, the court found the defendant guilty of the unlawful acquisition, possession, and transportation of psychotropic substances without the intent to sell, and based on Part 1 of Article 328 of the Criminal Code, sentenced him to restriction of liberty without direction to an open-type correctional institution for a term of one year and six months.
The sentence has entered into legal force.
