A previously unconvicted citizen B., while in a state of alcohol intoxication, in the yard of a house in Lepel, with the aim of unlawfully seizing a vehicle and driving it without intent to steal, took possession of the ignition key and alarm fob from a "NISSAN ALMERA" car belonging to citizen P., after which he opened it using the alarm fob, intentionally entered the car's cabin and drove it without intent to steal through the streets of Lepel.
The court recognised the defendant's sincere remorse as a mitigating circumstance.
The court recognised the commission of the crime by a person in a state of alcohol intoxication as an aggravating circumstance.
Taking into account the position of the state prosecutor, the court found the defendant guilty of the crime provided for by Part 1 of Article 214 of the Criminal Code of the Republic of Belarus and imposed a penalty in the form of correctional labour for a term of 1 year with the retention of 15% of earnings to the state revenue, but not less than 1 base unit per month. Citizen P. was also compensated 1000 roubles for material damage.
The sentence has entered into legal force.
