The Prosecutor's Office of Lepel District supported the state prosecution under Part 2 of Article 295 of the Criminal Code of the Republic of Belarus.
A citizen M., previously not convicted, on one of the days in June 2023, while at the training ground of the 19th Guards Separate Mechanized Brigade "Lepel" in the village of Zaslonovo, near a homemade fence installed near a tent camp, found two cartridges on the ground. These cartridges are ammunition for rifled firearms and can be used for firing Kalashnikov assault rifles and machine guns. He took the said cartridges, carried them to his apartment in the village of Zaslonovo, where he kept them until they were discovered and seized by law enforcement officers. He did not intend to sell the discovered cartridges.
The court recognised the sincere remorse of the accused as a mitigating circumstance.
The court did not establish any aggravating circumstances.
Taking into account the position of the state prosecutor, the court found the accused guilty of illegal acquisition, possession, and carrying of ammunition (except for ammunition for hunting smoothbore firearms) and, based on Part 2 of Article 295 of the Criminal Code of the Republic of Belarus, sentenced him to correctional labour for a term of 1 year and 6 months with 15% of his earnings withheld for the benefit of the state, but not less than 1 base unit monthly, without a fine, and deprived of the military rank of "ensign".
The sentence has entered into legal force.
