From April 16 to October 15, the destruction of bird nests is prohibited and entails administrative liability. Article 15.32 of the Code of the Republic of Belarus on Administrative Offences provides for administrative liability for illegal destruction of bird nests in the form of a fine for an official or an individual of up to thirty basic units, for an individual entrepreneur – from ten to one hundred, for a legal entity – from twenty to five hundred basic units.
In addition, in case of illegal destruction of bird nests, compensation for damage caused to the environment is required. The damage is determined according to the tariffs provided in the annex to the Decree of the President of the Republic of Belarus of December 8, 2005 No. 580 "On Certain Measures to Increase the Effectiveness of Hunting and Fishing Activities, and Improve their State Management".
The spread and number of birds that impair the sanitary and aesthetic condition of settlements, residential, industrial, cultural, domestic and other buildings and structures, or cause distress to residents of settlements, may be regulated by destroying nests located on plantings in settlements, residential, industrial, cultural, domestic and other buildings and structures during the period from October 16 to April 15.
To create favorable conditions for the reproduction of wildlife, during the period from April 16 to October 15, attention should be paid by commissions established by local executive and administrative bodies to resolve issues of removal of plant objects, to the necessity of drawing up an act confirming the absence of bird nests on the plantings planned for removal before making a decision on felling, transplanting, pruning, etc.
