On September 9, Vitebsk / Sergey Kochetov - BELTA /. The increase in foreign currency exchange rates in itself cannot be sufficient grounds for terminating a contract between business entities. This was announced today during a reception via video conferencing for citizens and representatives of business entities of the Vitebsk region by the Chairman of the Supreme Economic Court Viktor Kamienkov, a BELTA correspondent reports. Answering a question from a lawyer of the regional bar association regarding court practice on claims for termination of contracts due to the devaluation of the Belarusian ruble as a significant change in circumstances, Viktor Kamienkov said that there are not many such cases yet. "Based on the existing court practice, we have concluded that the increase in foreign currency exchange rates in itself cannot be sufficient grounds for terminating a contract," noted the Chairman of the SEC. In such a situation, one can protect their rights in different ways, but the SEC sees no sufficient grounds to make the issue of contract termination mandatory, he added. At the same time, according to Viktor Kamienkov, in each specific case, it is necessary to analyze the totality of the conditions specified in Art. 421 of the Civil Code of Belarus. Decisions on such cases will be made depending on the specific circumstances. Specialists from enterprises of the Vitebsk region asked questions related to the fulfillment of contractual obligations, debt collection, as well as the new procedure for dispute resolution, which is provided for by the Law of Belarus "On Amendments and Additions to Certain Codes of the Republic of Belarus on Improving Economic Proceedings", which entered into force on January 31, 2011. Following the reception, answering a question from a BELTA correspondent, Viktor Kamienkov noted that there is no significant increase in bankruptcy applications in the economic courts, although it is possible that by the end of the year there will be a slight increase of several dozen such applications compared to 2010. At the same time, the economic justice system predicted a possible increase in cases related to inflation and the devaluation of the Belarusian ruble, but this did not happen either. "Today, we have only about 40 cases related to these processes," added Viktor Kamienkov.-0-
