Citizen A. was accused of intentionally, while in a state of alcoholic intoxication, by opening a window with a metal rod, breaking into a house, from which he secretly stole a chainsaw and gasoline, after which he fled the scene and caused damage to the victim S. in the total amount of 407 rubles 37 kopecks.
The court of Lepel District considered a criminal case on the accusation of a resident of the village of Poddubye, Lepel District, under Part 2 of Article 205 of the Criminal Code of the Republic of Belarus. Citizen A. was accused of intentionally, while in a state of alcoholic intoxication, by opening a window with a metal rod, breaking into a house, from which he secretly stole a chainsaw and gasoline, after which he fled the scene and caused damage to the victim S. in the total amount of 407 rubles 37 kopecks.
Thus, in May, he was helping local residents cultivate their gardens, and after work, he decided to drink and visit his friend for further consumption of alcoholic beverages. However, his friend was not at home, so he decided to break into his house and steal a chainsaw, as he knew it was there. He entered the house through the window; the chainsaw was in the room by the window. He also took a canister of gasoline, then climbed out of the house through the window, loaded all the stolen items onto a cart, and drove home.
The next day, police officers arrived at Citizen A.'s residence, and he voluntarily confessed to the theft and handed over the stolen property.
Both during the preliminary investigation and the court proceedings, the accused admitted his guilt and sincerely repented.
By the sentence of the court of Lepel District, the accused was found guilty of committing secret theft of property (larceny), committed repeatedly, with unlawful entry into a dwelling, and was sentenced to one year and three months of restriction of liberty without being sent to an open correctional facility. The court's sentence has not yet entered into legal force.
