The Lepel District Court has considered a criminal case against a native of the village of Zvezda, Lepel District, who committed a crime under Part 2 of Article 317 of the Criminal Code of the Republic of Belarus.

A native of the village of Zvezda is accused of failing to ensure safe conditions for other road users while driving a MAZ vehicle within the territory of the Lepel district union transport unit, misjudging the road situation, thereby violating clauses 7, 7.1, 7.2, 9, and 9.10 of the Traffic Regulations.

Specifically, the native of the village of Zvezda entered the territory of the Lepel district union transport unit, stopped the MAZ vehicle, and in violation of the Traffic Regulations, without turning off the engine or engaging the reverse gear, failed to take all measures to prevent the vehicle from moving spontaneously. He then left the driver's seat and exited the MAZ vehicle's cabin, resulting in the vehicle moving backwards and hitting the victim who was located between the vehicle and the garage wall. As a result of this road traffic accident, the victim sustained grievous bodily harm.

By his actions, the native of the village of Zvezda violated the requirements of the Traffic Regulations, the breach of which is in direct causal connection with the road traffic accident that occurred and the grave consequences, leading to the unintentional infliction of grievous bodily harm to the victim.

Both during the preliminary investigation and the court proceedings, the native of the village of Zvezda pleaded guilty and expressed sincere remorse.

Taking into account the opinion of the state prosecutor, the court of Lepel District found the native of the village of Zvezda, a resident of Lepel District, guilty of committing a crime under Part 2 of Article 317 of the Criminal Code of the Republic of Belarus and sentenced him to imprisonment for a term of 2 years, with a ban on engaging in certain activities related to the operation of all types of vehicles for a period of 5 years. In accordance with Part 1 of Article 78 of the Criminal Code of the Republic of Belarus, the main sentence of imprisonment shall not be executed if he does not commit a new crime within two years.

In accordance with Part 5 of Article 78 of the Criminal Code of the Republic of Belarus, the native of the village of Zvezda is obliged to pay a criminal legal compensation to the state revenue in the amount of 40 base units.
