The court of Lepel District has considered a criminal case against a native of Lepel city who committed a crime under Part 2 of Article 205 of the Criminal Code of the Republic of Belarus.

The court of Lepel District considered a criminal case against a native of Lepel who committed a crime under Part 2 of Article 205 of the Criminal Code of the Republic of Belarus.

A previously convicted native of Lepel, in mid-May 2019, was at the home of his acquaintance A., to whom he had come to borrow money. Acquaintance A. did not lend him money but treated him to alcohol. When the alcohol ran out, citizen A. fell asleep, and the accused stayed in the apartment for a while longer and decided to go home. Leaving the kitchen, he saw a mobile phone on the table and decided to steal it. He took the mobile phone, put it in his jacket pocket, and went home to his cohabitant. On the way, he removed the SIM cards from the phone and threw them away, hiding the phone in the bushes near the house. After some time, citizen A. came to the cohabitant of the accused and began to demand the phone, which resulted in a scuffle between the accused and the victim, and the cohabitant called the police. The native of Lepel, after the incident, voluntarily told the police about the theft and returned the phone.

Both during the preliminary investigation and the judicial investigation, the native of Lepel admitted his guilt in stealing the mobile phone and sincerely repented.

Taking into account the opinion of the state prosecutor, the court of Lepel District found the native of Lepel guilty of committing a crime under Part 2 of Article 205 of the Criminal Code of the Republic of Belarus and sentenced him to 1 year of restriction of liberty without being sent to an open-type correctional institution. In accordance with Part 1 of Article 73 of the Criminal Code of the Republic of Belarus, by the totality of sentences, the unserved part of the sentence for the judgment of the Lepel District Court of 12.09.2018 in the form of a fine was fully added to the imposed punishment, and the final sentence was determined as 1 year of restriction of liberty without being sent to an open-type correctional institution and a fine in the amount of 784 rubles.
