The Prosecutor's Office of Lepel District supported the state prosecution against a 36-year-old resident of Lepel – he is charged with unlawful seizure of a vehicle and driving it, and intentional infliction of grievous bodily harm, which by negligence caused the death of the victim.
During the court investigation, it was established that a previously unconvicted 36-year-old resident of Lepel, while in a state of alcoholic intoxication, with the intent to unlawfully seize a vehicle and drive it without the purpose of theft, opened the lock with a key on the entrance gate of a garage located in GSPK No. 1, entered through an unlocked door into the cabin of a "Volkswagen" car, started the engine using the key located in the ignition switch, unlawfully seized the aforementioned vehicle, and drove it without the purpose of theft along Partizanskaya Street in Lepel.
While in a state of alcoholic intoxication at his place of residence, during an argument with his mother due to personal animosity, with the intent to intentionally inflict grievous bodily harm upon her, without desiring her death, but aware that his actions were causing his mother prolonged pain due to multiple traumatic impacts, thereby causing her particular physical and mental suffering, through torture, he intentionally struck D. with his hands, feet, and a lamp at least 53 times on various parts of her body, including: at least 11 times to the head and neck, and at least 42 times to the torso and limbs, as a result of which grievous bodily harm was inflicted upon his mother.
D.'s death occurred by negligence in a healthcare facility.
The accused D. essentially admitted guilt for the committed crimes during the court hearing.
Taking into account the evidence presented by the state prosecutor, the court passed a guilty verdict. For the totality of the crimes, the man was ultimately sentenced to 10 years and 1 month of imprisonment, to be served in a correctional colony under an enhanced regime.
The court applied compulsory measures for the security and treatment of the accused for chronic alcoholism.
The verdict has not entered into legal force. D. has appealed the verdict.
