On June 24, Minsk / Ekaterina Nechaeva - BELTA /. In Belarus, repeated review of cases in the Supreme Court will be permitted. This is stipulated by the draft law on amendments to certain codes of the Republic of Belarus concerning the improvement of the legal mechanism for reviewing court decisions. The document was adopted today at a meeting of the House of Representatives in two readings, according to a BELTA correspondent. As explained by Valentin Sukalo, Chairman of the Supreme Court, speaking in the Oval Hall, the current legislation provides for the possibility of protesting and verifying the legality of decisions of district-level courts and courts equivalent to them three times, the legality of decisions of regional, Minsk city and Belarusian military courts twice, and the decisions of the Supreme Court once. Currently, decisions made by the Presidium of the Supreme Court when considering a case in a supervisory capacity are final and are not subject to review (except for cases of resumption of proceedings due to newly discovered circumstances). The new draft law is aimed at creating a legal framework for the introduction of a supervisory review of the legality and validity of court decisions in civil and criminal proceedings after their review at a meeting of the Presidium of the Supreme Court. In other words, there will be an opportunity for repeated review of cases, including in the Supreme Court. The draft law proposes to grant the right to make a final decision on verifying the legality and validity of court decisions to the Plenum of the Supreme Court. It includes all judges of the Supreme Court and the chairmen of regional, Minsk city and Belarusian military courts. The exclusive right to protest decisions will be vested in the Chairman of the Supreme Court and the Prosecutor General. MP Anfim Mikhalevich, presenting the draft law in the House of Representatives, noted that its adoption will contribute to the identification and elimination of possible judicial errors made at previous stages of judicial review, and will provide an opportunity to use all means for legal protection of the freedoms and rights of every citizen of Belarus. -0-
