A clear mechanism for the compensated and gratuitous alienation of state housing, its transfer within republican ownership, as well as the acquisition of residential premises into the ownership of the Republic of Belarus has been determined in Belarus. The corresponding Decree No. 388 "On the Procedure for Disposal of State Housing Stock" was signed by the President of Belarus on July 26, BelTA was informed by the press service of the head of state. The document is adopted for the purpose of comprehensive regulation of legal relations concerning the disposal of the state (republican) housing stock. The decree defines the competence of state bodies for the disposal of residential premises assigned to them, as well as residential premises under operational management or economic management of subordinate republican legal entities (part of them) or transferred for gratuitous use by non-state legal entities. It is established that by decision of state bodies, residential premises can be alienated to employees registered as in need of improved housing conditions. The sale of residential premises to such citizens will be carried out at the appraised value (but not higher than the market value). The alienation of residential premises owned by the Republic of Belarus to citizens not registered as in need of improved housing conditions, as well as to legal entities on a gratuitous or compensated basis, and the sale of residential premises at auction will be carried out by decision of the President of the Republic of Belarus. By decision of the Government, agreed with the head of state, gratuitous transfer to communal ownership of residential premises owned by the Republic of Belarus and under the operational management of the National Bank, the Administration of the President of Belarus, the Office of the President, the National Academy of Sciences of Belarus, other state bodies (state organizations) subordinate to the President, the Prosecutor General's Office, as well as the acquisition of residential premises into the ownership of the Republic of Belarus at the expense of the republican budget or gratuitously will be carried out. The Government will have the right to transfer residential premises within republican ownership, to alienate state housing in other cases defined by the decree. A detailed mechanism for making decisions on the sale of residential premises is enshrined in the Regulation on the Procedure and Conditions for the Sale of Residential Premises of the Republican Housing Stock, approved by the decree.
