The procedure for writing off state-owned property in Belarus has been simplified, and the decision-making process has been optimised. This is stipulated by Resolution of the Council of Ministers No. 764 of 13 November 2019, which was officially published today on the National Legal Internet Portal, BELTA reports.
The document has been adopted based on the norms of Decree No. 169 "On the Disposal of State Property".
As explained by the State Property Committee, the resolution, in particular, defines a number of terms and supplements the grounds for writing off property.
In order to reduce the timeframes and simplify the procedure, the process of making decisions on property write-offs and their approval has been optimised. In particular, structural divisions of state bodies, diplomatic missions and consular institutions of the Republic of Belarus, which have state property assigned to them under the right of economic management or operational management, as well as non-state legal entities to whom property has been transferred under a gratuitous use agreement, are granted the right in established cases to independently decide on its write-off. In this case, with regard to property transferred under a gratuitous use agreement, the lenders have the right to determine cases in which a decision on write-off will only be possible after their approval.
Taking into account the specifics of the work of diplomatic missions and consular institutions of the Republic of Belarus, which have property assigned to them under the right of operational management, the write-off of property in certain cases will be carried out in coordination with the Ministry of Foreign Affairs.
