A standard form of contract for the provision of services for the training, retraining, and professional development of drivers of mechanical vehicles has been approved in Belarus. The corresponding resolution of the Ministry of Transport and Communications dated September 1, 2015, No. 40, was published today on the National Legal Internet Portal, reports a BELTA correspondent.

According to the document, the service provider undertakes to fully provide the training service in accordance with the program and the contract; to conduct theoretical and practical classes according to the approved schedule. The service provider is also obliged to organize material and technical support in accordance with regulatory legal acts, to provide training vehicles of the appropriate category in technically sound condition for conducting classes, and to ensure polite, friendly, and attentive attitude of the service provider's employees towards the student.
The service provider has the right to set the time (schedule) for theoretical and practical classes. In case of impossibility of fulfilling its obligations due to the fault of the customer (late payment, missing more than 15% of classes, being in a state of alcoholic intoxication or in a state caused by the use of narcotic drugs, psychotropic substances), the contract may be terminated unilaterally without reimbursement of the payment made.
The student undertakes to fully study the theoretical course and complete the practical course of the program; to treat the service provider's material assets with care; not to appear for classes in a state of alcoholic intoxication or in a state caused by the use of narcotic drugs, psychotropic substances.
The payer is obliged to pay for the services rendered by the service provider under the terms of the contract. The student and the payer have the right to demand consideration of claims if they disagree with the results of the examinations.
A student has the right to request a transfer to another study group to complete their education in case of missing more than 15% of classes or failing to master the program in full due to valid reasons; to participate in the planning of practical training sessions for operating MTS.
The standard form of the contract stipulates that re-taking exams and conducting additional classes with the contractor are carried out for an additional fee at the level of economically justified costs and in accordance with the prices for additional services.
The terms of the standard contract may be amended and supplemented by signing an additional agreement thereto.
This resolution shall enter into force after its official publication.
