February 12, Minsk / Ekaterina Markovich - BELTA /. Belarus has introduced mandatory pre-qualification of participants in tender bidding. This decision is contained in Resolution of the Council of Ministers No. 88 of January 31, which has been officially published on the National Legal Internet Portal, BELTA reports.
The document has been prepared in accordance with paragraph 5 of Decree of the President of Belarus of December 31, 2013 No. 591 "On conducting procurement procedures in construction". The Resolution approves the Regulations on the procedure for organizing and conducting procurement procedures for goods (works, services) in the construction of facilities. One of the innovations in the new version of the Regulations is the mandatory pre-qualification of participants when placing orders in tender bidding (bidding).
The pre-qualification procedure for participants includes the preparation of selection documentation by the bidding organizer and its provision in written or electronic form, invitation and registration of applicants who have submitted an application, consideration of the submitted documents by the tender committee, their analysis and summarization, as well as the adoption of a decision on the further participation of participants in tender bidding.
During the pre-qualification, indicators such as the number of employees involved in fulfilling the order, their professional and qualification composition, the availability of the necessary material and technical and information base, licensed software, the participant's ability to perform the entire scope of design and survey work on their own, business reputation, and others will be taken into account. Compliance with these indicators is necessary when placing orders for design and survey work.
Regarding the placement of orders for the execution of specific types of construction works, including installation, special, commissioning, and other works, participants of the preliminary qualification selection must confirm their experience in performing similar works, demonstrate the availability of production and technical potential, special equipment, and, if necessary, a declaration of conformity or a certificate of conformity for the works. When placing orders for the procurement of goods during the construction of facilities, the presence of a quality management system compliant with ISO 9000 international standards, after-sales service, etc., is sufficient. The regulation also provides for a list of indicators for participants of the preliminary selection when placing orders for the provision of engineering services.
The document states that if, as a result of the preliminary qualification selection, none of the participants pass the selection or only one participant passes it, the tender shall be deemed to have failed.
The regulation also establishes that competitive tenders (tenders) may be conducted in the form of an open or closed competition. The closed form of competition shall be applied when placing orders for special-purpose facilities, explosive construction facilities, facilities related to ensuring train traffic safety, the development and operation of railway transport, and ensuring the energy security of the economy and the population's livelihood at operating energy facilities. In other cases, tenders shall be conducted in the form of an open competition.
If conducting competitive tenders (tenders, negotiations) when placing orders necessary for the construction of facilities is not mandatory, the investor, developer, client, contractor, engineer, or engineering organization has the right to appoint and conduct them in the manner prescribed by the regulation.
The document also defines and approves the tender documentation for conducting competitive tenders for the execution of works in the construction of facilities, the procedure for conducting tenders, negotiations, concluding contracts, and resolving disputes.
The Ministry of Architecture and Construction of Belarus is granted the right to clarify issues related to the application of this regulation. The document applies to relations concerning the procurement of goods (works, services) in construction, if the procedures for such procurement were initiated after January 1, 2014.-0-
