A new procedure for establishing repeated exceptions from the national regime in public procurement will be developed within the Eurasian Economic Union, BELTA was informed by the EEC press service.
The new procedure will be developed based on a basic mechanism, which was reported at a meeting of the EAEU Council by Serik Zhumangarin, Member of the Board (Minister) for Competition and Antitrust Regulation. "As a result of joint work with EAEU participants, a basic mechanism for establishing repeated exceptions from the national regime has been developed," he noted. "In the future, it will ensure mutual access of business representatives to public procurement of the Eurasian Economic Union member states."
Currently, the EAEU Treaty provides for the right of a state to unilaterally (in accordance with its legislation) in exceptional cases establish exceptions from the national regime in public procurement for a period not exceeding two years. "The essence of exceptions from the national regime is that suppliers of goods, works, and services from other member states of the Eurasian Economic Union cannot participate in the public procurement of another member state due to the fact that the mechanism for establishing exceptions involves the possibility of purchasing goods, works, and services only within one state," the EEC explained. "By the instruction of the EAEU Council, the new procedure will stipulate that in case of objections from one or more member states, the decision on the impossibility of establishing repeated exceptions from the national regime in the field of public procurement will be made by the EAEU Board by consensus."
