Amendments on notarization of copyright infringement facts on the internet have come into force

July 12, Minsk /BELTA correspondent/. The Law "On Amendments and Additions to Certain Laws of the Republic of Belarus on Notarial Activities" comes into force on July 12, the Ministry of Justice press service informed BELTA.

As explained by the Ministry of Justice, notaries will be empowered to secure written evidence for court proceedings. In particular, this may include documenting instances of copyright infringement on the internet.

"A notary secures written evidence prior to the initiation of court proceedings if the person requesting it believes that the presentation of such evidence will subsequently become impossible or difficult," the ministry stated.

Upon a written application from clients, notaries will examine submitted evidence, including publicly available information. This pertains to printed texts, graphic records, and so forth. Screenshots of web pages, as well as electronic versions of evidence (including on USB drives, discs), may be attached to the inspection report.

"Such written evidence may be presented in court for consideration," the Ministry of Justice explained.

For securing written evidence for general jurisdiction court proceedings, a fee of 2 base units will be charged (currently, one base unit is Br150 thousand). In turn, the notarial fee for inspecting written evidence and drawing up an inspection report will range from two to six base units, depending on the time spent.-0-
