The Supreme Economic Court of Belarus proposes to enhance the role of executive authorities, from district executive committees to the government, in resolving non-payment issues, including the reduction of external accounts receivable. This was announced to journalists by the Chairman of the Supreme Economic Court, Viktor Kamienkov, in response to a question from a BELTA correspondent. In Vitebsk, he held a reception for citizens and representatives of economic entities via videoconference. "Today, at all levels, we are initiating the issue of enhancing the role of executive authorities in resolving such matters, for which they have great potential," noted the Chairman of the SEC. Currently, commissions, conventionally referred to as non-payment commissions, operate at the level of regional executive committees; their task is to resolve issues of payment discipline of economic entities. Depending on the effectiveness of these commissions, settlements between economic entities either become the subject of judicial dispute or are resolved out of court. "If the commission at the city executive committee in Minsk operates effectively, then the economic court has fewer cases related to debt recovery, whereas in the regions, such commissions operate less effectively," noted Viktor Kamienkov, adding that this also applies to issues of external accounts receivable recovery. The SEC proposes to reorganize such commissions and grant them the functions of monitoring the fulfillment of contractual obligations. This is partly due to the fact that claims for significant amounts related to the violation of the deadline for fulfilling obligations are already being filed with the economic courts. At the same time, the potential of economic justice is being maximally utilized to resolve issues related to non-payments. Regarding the resolution of problems in recovering external debt, Belarusian economic courts are entitled to consider such cases if the economic entity has ensured competent legal support for its business by making appropriate entries in the foreign economic contract, explained Viktor Kamienkov. -0-
