Due to the amendments to the Law of the Republic of Belarus of 13.07.2012 No. 419-Z "On Public Procurement of Goods (Works, Services)" (as amended on 17.07.2018) (hereinafter referred to as the Public Procurement Law), which entered into force on 01.07.2019, many government bodies and organisations of all forms of ownership forget about the significant changes in this legislation and commit violations in their activities.
Due to the amendments to the Law of the Republic of Belarus of 13.07.2012 No. 419-Z "On Public Procurement of Goods (Works, Services)" (as amended on 17.07.2018) (hereinafter referred to as the Public Procurement Law), which entered into force on 01.07.2019, many government bodies and organisations of all forms of ownership forget about the significant changes in this legislation and commit violations in their activities.
Pursuant to clause 2 of Article 19 of the Law of the Republic of Belarus of 13.07.2012 No. 419-Z, the Public Procurement Law stipulates that the annual public procurement plan is formed annually and, after approval by the contracting authority, shall be posted on the electronic trading platform within five working days, excluding information constituting state secrets.
Thus, paragraph 3 of clause 3 of Article 49 of the Public Procurement Law obliges the contracting authority to post information on the conduct of a single-source procurement procedure on the electronic trading platform no later than one working day following the date of its approval.
It should also be noted that the state information and analytical system GIAS has been created to replace the official website icetrade.by. This system accumulates all information on public procurement:
- Annual procurement plans;
- Documentation for public procurement and requests for its clarification;
- Protocols for public procurement procedures;
- Registers of contracts and complaints;
- Information on prices resulting from public procurement;
- Standard contract forms established by the Council of Ministers, etc.
