The court of Lepel District considered a criminal case on the charges of a resident of Lepel under Part 1 of Article 205 of the Criminal Code of the Republic of Belarus. Citizen N. was accused of intentionally, through free access, secretly stealing a wallet with money from the pocket of a jacket, which was in a utility wagon located on the construction site.
The accused worked at this construction site, and his victim was his colleague, whom he had known for several years.
Thus, on the morning of one of the working days, the accused noticed the wallet in the victim's jacket pocket when the latter was taking out cigarettes. The jacket remained hanging in the utility wagon. During lunch, the accused was the first to go to the utility wagon to change clothes, and during this, he again saw the wallet in his colleague's jacket. It was then that he decided to seize the property of another, took the wallet out of his pocket and took it for himself. After that, he went home, where he hid the stolen goods. After lunch, the accused saw that the victim was looking for the wallet, employees of the Department of Internal Affairs arrived, interviewed everyone, including him, but he did not admit to the theft.
In the evening, he took 5 rubles from the stolen wallet, which he used to buy cigarettes and a bottle of wine.
The next day, the accused decided to return the stolen property to the rightful owner because he felt ashamed of his actions. Upon arriving at work after lunch, the accused returned the wallet with its contents to the victim and apologized. A few days later, he also returned the 5 rubles he had spent. The victim forgave his colleague but decided that everyone should know about what happened and that such actions should not go unpunished. Previously, citizen N. had not been brought to criminal or administrative liability, and he was characterized positively at work and at home.
By the sentence of the court of Lepel District, the accused was found guilty of secret theft of property (larceny) and was sentenced to 120 hours of community service. The court's sentence has entered into legal force.
